Children Not to Be Used as Shields by the Separating Parents

- The Bombay High Court in a recent judgement in a public interest litigation observed that there is a trend in divorced or separated parents, wherein the parent having custody of children attempts that child access is not given to the non-custodial parent in contravention of child access and custody guidelines.
- The Hon’ble High Court observed that it is unfortunate that parents use children as weapons to fight against each other and the children suffer from emotional turmoil at home. The children involved in parental disputes are of tender age and they need financial and emotional support from their parents.
- The Hon’ble Court discouraged the practice child meeting the non-custodial parent in the court compound, as it adversely affects the child’s thinking process.
