Are Judges Currupt?
- In case of a litigation both the parties desire to have favorable judgments and some of them are ready and willing to adopt unethical practice of bribing the judge. Most of the lawyers conduct matters on the basis of merit of a case and they do not indulge in any kind of malpractice, however very few middlemen who tell their clients that they have direct contact with the judge and they can influence outcome of their case. The unsuspecting client agrees to pay the middlemen for influencing the judge.
- Mostly the Judges are non corrupt and they passes judgment based on the evidence produced before him by the parties and application of law to the facts of a case. The middlemen takes money from the unsuspecting desperate client and pockets it once order is passed in favour of his client, however if order is passed in favour of the opponent then the middlemen claims that the opponent had paid more to the judge. In case of adverse order the middle men returns the money and at times they deduct some amount on account of expenses. Rarely the middlemen claim that the judge is not returning the money and there is no way mechanism to recover money from a judge.
- The judicial functioning is based on the principal of independence, accountability and integrity. In India judges are free from external pressure, political influence.
- The middlemen mislead the unsuspecting/desperate client and it is advised to remain away from such cunning persons.
- Any order or judgment passed by a judge is subject to review or appeal by the higher courts and if any bonafide procedural discrepancy is found in the order then it may be reversed by the higher court. Any unfavorable order/judgment is result of application of judicial mind to the facts of the case and law. In case any order/judgment is found to be against the principal of justice, equity, good conscience and principals of law then internal disciplinary proceedings are commenced under the constitutional process against the judge against whom allegations are made.
