Threats Of Filing False Criminal Cases By The Wife During Matrimonial Disputes
1. If a wife inflicts injuries on her body and threatens to file false criminal complaints against the husband and his family members, then the husband has three options:
i) Collect more video evidence of her misconduct.
ii) File pre-litigation in the family court.
iii) File divorce petition immediately.
2. These threats are usually manipulations, a tool to pressurize the husband to remain fearful and to agree to her terms. The wife may have no intention of filing any police complaint against the husband.
3. The wife may stage attack on herself to make her claim strong. The husband may collect more videos silently if you can want to. This video evidence can be used to prove husbands innocence if the need arises.
4. The husband must collect following evidences:-
i) Video & audio recording.
ii) Emails and messages.
iii) Affidavits of witnesses.
4. Once husband is sure that he does not wish to live with the wife, then he may file for pre litigation. The pre litigation has following steps:-
i) Mediation and counseling.
ii) Amicable settlement of disputes.
iii) Financial settlement.
iv) Reconciliation.
5. In case reconciliation is not possible then the husband may file for divorce on the ground of mental cruelty, desertion etc, depending on the facts of the case.
