  1. INTRODUCTION
    Maintenance under matrimonial law plays a crucial role in ensuring that a dependent spouse, usually the wife, is able to live with dignity after separation. Courts in India have repeatedly emphasized that maintenance is not a matter of charity but a legal right that arises out of the marital relationship. The determination of maintenance, however, is not static. It must respond to changes in financial circumstances, social needs, and the realities of inflation.A recent judicial trend has highlighted that a substantial increase in the husband’s income and the general rise in the cost of living are relevant considerations for enhancing maintenance. This article examines the rationale behind this principle and situates it within the larger framework of family law in India.
  2. MAINTENANCE AS A DYNAMIC OBLIGATION
    The law recognizes maintenance as a continuing obligation that evolves with time. Section 125 of the Code of Criminal Procedure, 1973 (CrPC), as well as provisions under the Hindu Marriage Act, 1955 (HMA), and the Hindu Adoptions and Maintenance Act, 1956 (HAMA), confer upon the wife the right to claim maintenance. The Supreme Court has clarified that the amount awarded is not fixed permanently; it may be revised depending on changes in circumstances.
    In Manish Jain v. Akanksha Jain, the Court held that the determination of maintenance must be realistic and should take into account the status of the parties and the husband’s capacity to pay. This approach aligns with the principle that maintenance is meant to secure a standard of living similar to that enjoyed during the subsistence of marriage.

Rita Dey Chowdhury Nee Nandy, the Supreme Court underscored that maintenance is not limited to bare survival but must ensure a life consistent with the social and financial position of the husband.

    Apart from income, inflation and rising costs of essential commodities significantly affect the adequacy of maintenance. What may have been sufficient at the time of the original award can become wholly inadequate over time due to economic changes. Recognizing this, courts have allowed upward revisions of maintenance in line with inflation.The Delhi High Court in Annurita Vohra v. Sandeep Vohra observed that maintenance should not be fixed at a rigid figure; instead, it should reflect both the husband’s resources and the prevailing cost of living. This ensures that maintenance remains a living concept and not a static number.
  5. BALANCING EQUITY AND RESPONSIBILITY
    While enhancing maintenance, courts also consider the husband’s financial responsibilities, including dependents such as children or elderly parents. However, the principle remains that the wife should not suffer a diminished standard of living when the husband’s financial condition improves. This approach maintains equity between the spouses and reflects the continuing nature of marital obligations.
